Agreeing to this
These terms are an agreement between you and MAROTECH SOLUTIONS of Kuala Lumpur, Malaysia ("we", "us"), which runs NextPass. By creating an account or using the app, you agree to them. If you use NextPass for a business, you agree for that business too, and you confirm you may do so.
Your account
- You must be 18 or older.
- Give a real email address you can read, and keep your password to yourself. You are responsible for what is done with your account.
- Tell us straight away at support@nextpass.my if you think someone else has used it.
What you must not do with it
- Break the law, or anyone else's rights, with it.
- Use it to send spam, or to deceive or defraud anyone.
- Try to reach other people's data, test or break our security, or put a heavy load on our servers on purpose.
- Upload anything harmful, such as viruses, or copy, resell or take apart the app.
What you put in it stays yours
What you enter in NextPass belongs to you. You let us store and process it only to run NextPass for you, as our Privacy Policy describes.
Your customers' data
If you run a business on NextPass, the names and phone numbers of your customers that you or your staff enter, or that your customers type on your queue page, are your business's records. You are responsible for them under the Personal Data Protection Act (the data user); we keep and process them only to run your queues, on your behalf, and as our Privacy Policy says. Collect only what you need, tell your customers who you are, and answer their requests about their data. Names and phone numbers are deleted after the time you choose (7, 30 or 90 days). Only you and your staff see them; your staff's access ends when you remove them or your Pro plan ends.
What is ours
The app, its design, its name and its logo belong to us. You may use the app as these terms allow, and nothing more.
What it costs
Free
The Free plan costs nothing. It includes 50 customers a day, and may change; we will tell you in the app first.
Pro
- NextPass Pro is a subscription, monthly or yearly. Its price is shown in the app before you buy.
- You pay through your phone's app store account, which takes the payment when you confirm the purchase.
- Free trial. New subscribers may get Pro free for the first 7 days, when the app store shows the offer before you buy (one trial per app store account). Unless you cancel at least 24 hours before the trial ends, the subscription starts and your app store account is charged.
- It renews automatically at the same price unless you cancel at least 24 hours before the end of the current period. Your app store account is charged within 24 hours before each renewal.
- Cancel any time in your app store account's subscription settings. Pro stays on until the end of the period you paid for. Deleting the app or your account does not cancel the subscription by itself.
- Refunds are handled by the app store under its own rules.
- If we change the price, the app store will tell you before it applies, and you can cancel before then.
What we do not promise
We work to keep NextPass running and your data safe, but we provide it "as is". We do not promise it will always be available or free of faults, or that every notification will arrive. Keep your own copies of anything you must keep by law.
As far as the law allows, we are not liable for indirect losses such as lost profit, lost business or lost data, and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms takes away rights you have as a consumer that the law says cannot be taken away.
Ending it
You can stop using NextPass and delete your account at any time. We may suspend or close an account that breaks these terms, puts others at risk, or is used for fraud. Where we can, we will tell you why first.
The app stores
These terms are between you and us only, not Apple or Google. Apple and Google are not responsible for the app or its support. If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies, and Apple and its subsidiaries may enforce these terms as third-party beneficiaries.
Which law, and where
The law of Malaysia governs these terms, and the courts of Malaysia decide any dispute about them.
Changes
When these terms change, the date at the top changes. If a change matters, we will tell you in the app before it applies. If you keep using NextPass after that, you accept the new terms.
